Terms & Conditions

1. INTRODUCTION AND ACCEPTANCE

These Terms and Conditions ("T&C", "Terms", or "Agreement") constitute a legally binding agreement between you ("User", "Client", "You", or "Your") and OZRABAS GLOBAL WAYFARER SERVICES ("OZRABAS", "the Company", "we", "us", or "our"), a Proprietorship firm registered and operating from Jaipur, Rajasthan, India.

Binding Agreement Notice

BY ACCESSING OUR WEBSITE, MAKING AN ENQUIRY, INITIATING A BOOKING, MAKING ANY PAYMENT, OR USING ANY SERVICE OFFERED BY OZRABAS, YOU UNCONDITIONALLY AND IRREVOCABLY ACCEPT THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE ALL INTERACTIONS WITH OZRABAS.

These Terms supersede all prior verbal, written, email, WhatsApp, social media, or any other informal communication between you and OZRABAS. Only the services explicitly confirmed in writing by OZRABAS shall form part of the final binding agreement.

2. DEFINITIONS

"OZRABAS": OZRABAS GLOBAL WAYFARER SERVICES, a Proprietorship firm, including its proprietor, employees, agents, representatives, and authorized vendors.

"User / Client": Any individual, group, company, or entity that accesses, enquires, books, or avails any service from OZRABAS.

"Booking": Any confirmed reservation for travel services including hotel stays, flights, cabs, visa assistance, holiday packages, B2B services, or affiliate services, confirmed in writing by OZRABAS.

"Services": All travel-related services facilitated or arranged by OZRABAS, whether directly provided or procured through third-party vendors and suppliers.

"Quotation": A formal written communication issued by OZRABAS detailing the itinerary, inclusions, exclusions, pricing, and payment schedule. Upon payment, the Quotation becomes the definitive contract.

"Third-Party Supplier": Any airline, hotel, cab operator, visa agency, activity provider, or other travel service vendor engaged by OZRABAS to deliver components of the Services.

"Force Majeure": Any event beyond OZRABAS's reasonable control including natural disasters, pandemics, war, strikes, government actions, or other unforeseeable circumstances.

"Platform": The website www.ozrabas.com, mobile applications, social media channels, WhatsApp, and any other digital or physical medium used by OZRABAS.

3. SCOPE OF SERVICES

OZRABAS offers the following travel services, subject to these Terms:

  • Hotel Bookings (domestic and international)
  • Flight Bookings (domestic and international)
  • Visa Assistance and Documentation Support
  • Cab and Ground Transfer Services
  • Holiday Package Design and Execution
  • Affiliate Partner Services
  • B2B Travel Services
  • Third-Party Vendor Service Facilitation

OZRABAS operates both as a direct service provider and as a facilitator/intermediary between clients and third-party suppliers. The role of OZRABAS in each booking shall be as stated in the applicable Quotation.

4. ROLE & LIMITATION OF OZRABAS

4.1 As Facilitator

For services procured through third-party suppliers (airlines, hotels, activity operators, visa agencies, etc.), OZRABAS acts solely as a booking intermediary. In such cases:

  • OZRABAS does not own, operate, or control the facilities or services of third-party suppliers.
  • Descriptions, amenities, inclusions, and pricing provided by third parties are based on information supplied to OZRABAS and are not independently verified.
  • OZRABAS does not guarantee the accuracy, availability, quality, safety, or adequacy of third-party services.
  • Any discrepancy, shortfall, dispute, or claim arising from third-party services must be directed to the respective supplier. OZRABAS may assist in communication but accepts no financial or legal liability.

4.2 As Principal Tour Operator

For holiday packages and curated tours operated by OZRABAS, the Company acts as principal operator and assumes responsibility for itinerary design and supplier coordination. However, OZRABAS's liability is capped as set out in Clause 12 (Limitation of Liability).

5. BOOKING PROCESS & CONTRACT FORMATION

A binding booking contract is formed only when ALL of the following conditions are met:

  • OZRABAS issues a formal written Quotation or Booking Confirmation.
  • The User accepts the Quotation in writing (email/WhatsApp acceptance is valid).
  • The required advance payment is received and credited to OZRABAS's account.

No booking shall be considered confirmed on the basis of verbal commitments, informal chats, or social media discussions. The final written Quotation and payment receipt together constitute the binding contract and supersede all prior communications.

IMPORTANT AVAILABILITY NOTICE

IMPORTANT: Availability of hotels, flights, and other services is subject to change until the booking is formally confirmed in writing by OZRABAS. OZRABAS reserves the right to substitute confirmed services with comparable alternatives in case of unavailability, without liability.

6. USER OBLIGATIONS

6.1 Accuracy of Information

Users must provide complete, accurate, and truthful information including but not limited to full names (as per passport/ID), dates of birth, nationality, passport details, contact information, dietary requirements, and medical conditions. OZRABAS shall not be liable for any loss, denial of service, visa rejection, or travel disruption caused by inaccurate or incomplete information provided by the User.

6.2 Documentation & Travel Requirements

  • It is the User's sole responsibility to hold valid travel documents including passports, visas, permits, and health certificates.
  • Users must independently verify and fulfill all entry, transit, and health requirements for destination countries.
  • OZRABAS shall not be held responsible for denied boarding, immigration refusal, or any consequence arising from the User's failure to possess valid documentation.
  • International users must carry valid government-issued photo ID at all times during travel.

6.3 Payment Responsibility

Users must adhere strictly to the payment schedule outlined in the Quotation. Failure to meet payment deadlines shall entitle OZRABAS to cancel the booking and forfeit all amounts paid, as detailed in Part III of this document.

6.4 Code of Conduct

Users and their travel companions agree to:

  • Behave responsibly and lawfully throughout the trip.
  • Comply with instructions issued by OZRABAS staff, tour captains, guides, and transport operators.
  • Refrain from actions that may endanger, disturb, or inconvenience other travelers, OZRABAS staff, or third parties.
  • Abstain from alcohol consumption that impairs judgment or causes disturbance. OZRABAS accepts zero liability for injuries, accidents, or loss arising from intoxication.
  • Respect the laws, customs, and regulations of destination locations.

OZRABAS reserves the right, without liability, refund, or compensation, to terminate a User's participation in any trip mid-journey if their conduct is deemed inappropriate, dangerous, or in breach of these Terms. All costs arising from such termination shall be borne solely by the User.

6.5 Property & Damage

Users shall be personally and financially liable for any damage caused to accommodation, transport, property, or equipment beyond normal wear and tear. OZRABAS reserves the right to recover such costs directly from the User.

6.6 Safety Responsibility

Users acknowledge and accept that certain travel services may involve inherent risks including but not limited to adventure activities, trekking, high-altitude travel, remote destinations, and road travel. Users voluntarily assume all such risks and release OZRABAS from any related liability.

7. MEDICAL & HEALTH DECLARATION

Users with pre-existing medical conditions, disabilities, allergies, or dietary restrictions must disclose the same to OZRABAS in writing at the time of booking. OZRABAS reserves the right to:

  • Require a physician's fitness certificate before confirming bookings for physically demanding tours or high-altitude destinations.
  • Refuse or terminate participation if a User's health condition poses a risk to themselves or others.

OZRABAS shall not be liable for any injury, illness, medical emergency, or fatality arising during the trip, including those arising from pre-existing conditions, altitude sickness, food-related illness, or accidents. All medical expenses shall be borne exclusively by the User. Travel insurance with medical coverage is strongly recommended for all trips.

8. FLIGHT SERVICES

  • Flight bookings are facilitated by OZRABAS through airline vendors and booking systems. All airline operations, including delays, rescheduling, cancellations, and baggage policies, are governed exclusively by the respective airline's terms.
  • OZRABAS accepts no liability for flight delays, cancellations, missed connections, or any loss arising from airline-related disruptions.
  • Flight prices are subject to change until ticketed and fully paid. Quoted prices are indicative only.
  • 100% of the flight cost is payable at the time of booking and is immediately non-refundable once ticketed.
  • Refunds for cancelled flights, if any, follow the respective airline's refund policy and are credited to the User only after receipt from the airline. OZRABAS is not responsible for the timeline or quantum of airline refunds.

9. HOTEL & ACCOMMODATION SERVICES

  • OZRABAS does not own or operate any hotel or accommodation facility. All hotel services are provided by independent third-party suppliers.
  • Room categories, inclusions, and amenities are as described by the hotel. Actual conditions may vary and OZRABAS provides no guarantees.
  • In the event of overbooking by a hotel, OZRABAS will make reasonable efforts to arrange comparable alternatives. Liability in such cases is limited to the value of the affected service.
  • Honeymoon packages, special inclusions, room upgrades, and similar benefits are subject to availability at the time of check-in and are not guaranteed by OZRABAS.
  • Local taxes, resort fees, security deposits, and any charges levied directly by the property are the User's sole responsibility.
  • Check-in and check-out times are as per hotel policy and OZRABAS bears no responsibility for early/late check-in or check-out issues.

10. VISA ASSISTANCE SERVICES

OZRABAS provides visa facilitation support by assisting with documentation and application submission. The following terms apply:

  • Visa issuance is at the exclusive discretion of the relevant embassy or consulate. OZRABAS makes no guarantee of visa approval.
  • All visa fees paid to embassies or consulates are strictly non-refundable, regardless of outcome.
  • Visa rejection does not exempt the User from cancellation charges applicable to the overall travel package.
  • OZRABAS shall not be liable for any additional expenses, losses, or inconvenience arising from visa rejection, delay, or denial of entry.
  • Users are solely responsible for obtaining any required transit visas. OZRABAS cannot assist with or be held responsible for transit visa denials or missed connections.
  • OZRABAS shall not be liable if a User is denied boarding due to incomplete documentation, travel bans, or any other reason.

11. TRANSFERS & GROUND TRANSPORT

  • Ground transport is arranged through contracted third-party operators. OZRABAS coordinates but does not operate transport services.
  • Transport schedules are subject to local conditions, traffic, and operational availability.
  • OZRABAS shall not be liable for delays, breakdowns, route changes, or accidents involving third-party transport providers.
  • Users are responsible for their personal belongings at all times. OZRABAS accepts no liability for loss, theft, or damage to luggage or personal items during transit.
  • Standard luggage allowance is one main bag plus one carry-on per person unless otherwise specified in the Quotation. Additional or oversized luggage may incur extra charges.
  • Unscheduled stops are at the driver's discretion and cannot be guaranteed. OZRABAS accepts no liability for arrangements made directly between Users and drivers.

12. LIMITATION OF LIABILITY

THIS IS A CRITICAL CLAUSE. PLEASE READ CAREFULLY.

To the fullest extent permissible under applicable law, OZRABAS, its proprietor, employees, agents, and representatives shall not be liable for:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages of any nature.
  • Any loss of profit, revenue, enjoyment, data, opportunity, or goodwill.
  • Any personal injury, illness, disability, or death occurring during or in connection with the trip.
  • Any loss, theft, or damage to personal belongings or property during travel.
  • Service failures, shortfalls, or deficiencies attributable to third-party suppliers.
  • Flight delays, cancellations, or rebookings by airlines.
  • Visa rejection, denial of entry, or immigration-related issues.
  • Events of Force Majeure including pandemics, natural disasters, government-imposed travel restrictions, civil unrest, or acts of God.
  • Any decision or action taken by the User against medical or safety advice.
  • Any loss arising from inaccurate information provided by the User.

OZRABAS's aggregate total liability for any and all claims arising from any booking shall be strictly limited to the net amount actually received by OZRABAS for that specific booking, excluding taxes, third-party fees, and airline costs. This cap applies regardless of the nature of the claim — whether in contract, tort, negligence, or otherwise.

13. DEFAMATION & NEGATIVE REVIEW CLAUSE

By booking with OZRABAS, you agree to the following binding clause on public communications.

The User agrees not to attack, criticize, defame, or disparage OZRABAS GLOBAL WAYFARER SERVICES, its proprietor, employees, associates, or partners publicly, including but not limited to:

  • Google Reviews, TripAdvisor, MakeMyTrip, or any travel review platform
  • Facebook, Instagram, Twitter/X, YouTube, LinkedIn, or any other social media platform
  • Public forums, blogs, news portals, or consumer complaint websites
  • WhatsApp groups or any digital community with 3 or more members

This clause applies before, during, and after the trip, without time limitation. Any review or public communication must be factual, non-defamatory, and in good faith. In the event of a breach, the User acknowledges that OZRABAS may pursue legal remedies including:

  • A claim for damages of a minimum of INR 1,00,000 (Rupees One Lakh) per instance of defamatory publication, in addition to any actual damages proven.
  • Injunctive relief and removal orders through competent courts in Jaipur, Rajasthan.
  • Recovery of all legal costs and expenses incurred by OZRABAS in pursuing such claims.

OZRABAS shall have the right to respond to any public communication made by the User about OZRABAS. Users who have a grievance are encouraged to use OZRABAS's official grievance channel before resorting to public commentary.

14. INDEMNIFICATION

The User agrees to fully indemnify, defend, and hold harmless OZRABAS, its proprietor, employees, agents, representatives, and affiliated vendors from and against any and all:

  • Claims, suits, proceedings, or actions initiated by third parties
  • Losses, damages, penalties, or fines arising from the User's breach of these T&C
  • Legal fees, court costs, or arbitration expenses
  • Losses arising from inaccurate information or documentation provided by the User
  • Claims arising from the User's conduct during the trip including property damage, injury to third parties, or violations of law
  • Any proceedings initiated by the User in a jurisdiction other than Jaipur, Rajasthan

15. FORCE MAJEURE

OZRABAS shall not be in breach of any obligation under these T&C, and shall not be liable for any failure or delay in performance, due to events beyond its reasonable control, including:

  • Natural disasters: earthquakes, floods, cyclones, landslides, fires
  • Pandemics, epidemics, or public health emergencies as declared by WHO, Government of India, or any State Government
  • War, civil unrest, terrorism, sabotage, or hostilities
  • Government-imposed restrictions, lockdowns, travel bans, or regulatory actions
  • Strikes, labor unrest, or industrial disputes affecting transport or hospitality sectors
  • Cyberattacks or technological failures beyond OZRABAS's control
  • Failure of airlines, hotels, or third-party vendors due to their own force majeure events

In force majeure circumstances, OZRABAS shall make commercially reasonable efforts to notify users and explore alternatives. No refunds, compensation, or liability shall arise from force majeure events. Trip costs or deposits already paid shall be governed by the Cancellation and No-Refund Policy in Part III.

17. DISPUTE RESOLUTION & GOVERNING LAW

EXCLUSIVE JURISDICTION: JAIPUR, RAJASTHAN, INDIA — NO EXCEPTION.

This Privacy Policy, and all matters arising out of or related to it, shall be exclusively governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.

ALL DISPUTES, CLAIMS, GRIEVANCES, OR CONTROVERSIES ARISING OUT OF OR IN CONNECTION WITH THIS PRIVACY POLICY, OUR TERMS AND CONDITIONS, OR THE USE OF OUR SERVICES SHALL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COURTS OF JAIPUR, RAJASTHAN, INCLUDING THE RAJASTHAN HIGH COURT (JAIPUR BENCH).

By accepting these Terms, the User irrevocably:

  • Submits to the personal jurisdiction of courts in Jaipur, Rajasthan
  • Waives any objection to venue in Jaipur
  • Waives any defense of inconvenient forum
  • Agrees that any judgment from Jaipur courts is binding and enforceable

Any legal proceeding initiated by the User against OZRABAS in any other court, tribunal, forum, or jurisdiction shall be void, and the User shall be liable for all legal costs incurred by OZRABAS in contesting such proceedings.

ARBITRATION: OZRABAS reserves the right to require binding arbitration before a sole arbitrator under the Arbitration and Conciliation Act, 1996 (as amended), seated in Jaipur, Rajasthan, conducted in English. The arbitral award shall be final and binding. OZRABAS may also seek interim relief from competent courts in Jaipur.

18. GENERAL PROVISIONS

18.1 Amendments

OZRABAS reserves the right to amend, update, or replace these Terms at any time without prior notice. Amendments become effective immediately upon posting on www.ozrabas.com. Continued use of OZRABAS services after any amendment constitutes unconditional acceptance of the revised Terms.

18.2 Severability & Waiver

If any provision of these Terms is found invalid, unlawful, or unenforceable by a competent court, the remaining provisions shall continue in full force. Failure by OZRABAS to enforce any provision shall not constitute a waiver of that provision or any other.

18.3 Entire Agreement

These Terms, together with the Quotation/Booking Confirmation and the Privacy Policy, constitute the entire agreement between OZRABAS and the User, superseding all prior oral, written, or digital communications. Only the services explicitly listed in the final written Quotation and paid for by the User shall form part of the confirmed agreement.

Part II

Payment Policy

1. Payment Schedule

All bookings with OZRABAS are subject to the following payment structure. Specific percentages and deadlines applicable to your booking will be confirmed in writing in your Quotation:

Standard Payment Schedule

  • Booking Initiation: A minimum of 30% of the Total Package Value is payable immediately to block and confirm the booking. No booking shall be held without this initial deposit.
  • Interim Payment (if applicable): Additional tranche as specified in the Quotation — typically due 45 to 60 days prior to travel.
  • Full & Final Payment: 100% of the Total Package Value must be cleared no later than 30 days before the date of departure.
  • Flight Component: 100% of the total flight cost is payable at the time of booking and is immediately non-refundable once ticketed.
  • Train Component: 100% of the total train IRCTC cost is payable at the time of booking and is immediately non-refundable once ticketed.
  • Visa Fees: 100% of visa fees are payable at the time of visa application submission and are non-refundable in all circumstances.

FAILURE TO MEET ANY PAYMENT DEADLINE SHALL ENTITLE OZRABAS TO CANCEL THE BOOKING WITHOUT NOTICE AND FORFEIT ALL AMOUNTS PAID. NO GRACE PERIOD IS GUARANTEED.

2. Payment Methods

OZRABAS accepts payments through the following channels:

  • Bank Transfer / NEFT / RTGS / IMPS to OZRABAS's designated bank account
  • UPI (as communicated by OZRABAS)
  • Online payment gateways including Razorpay, Stripe, PayU, Cashfree, and other authorized platforms
  • Cheque or Demand Draft (subject to prior approval; booking confirmed only upon clearance)

Payments must be made in the currency and manner specified in the Quotation. OZRABAS shall not be responsible for exchange rate fluctuations, banking charges, or transaction fees.

3. Payment Security & Fraud Protection

  • OZRABAS does not store sensitive card details. All card-based transactions are processed by PCI-DSS compliant third-party payment gateways.
  • OZRABAS is not liable for any unauthorized transaction, fraud, or data breach at the payment gateway's end.
  • Users are advised to make payments only through OZRABAS's official website or officially communicated bank details. OZRABAS is not responsible for payments made to unofficial or fraudulent accounts.

4. Price Changes & Surcharges

All quoted prices are based on rates available at the time of quotation. Prices are subject to change due to:

  • Airline fare revisions before ticketing
  • Hotel rate revisions before confirmation
  • Currency fluctuation for international packages
  • Government tax changes, fuel surcharges, or new levies
  • Peak-season surcharges imposed by suppliers

OZRABAS shall notify the User of any price revision before it is applied. The User may choose to accept the revised price or cancel; standard cancellation charges will apply if the User opts to cancel.

5. GST, TCS & Invoicing

  • All prices are inclusive/exclusive of GST as stated in the Quotation. GST is levied as per applicable Indian tax laws.
  • Tax Collected at Source (TCS) applies on overseas tour packages as per the Income Tax Act, 1961.
  • TCS certificates shall be issued within 45 days after the close of the relevant financial quarter.
  • GST invoices shall be issued on request after payment and service delivery. Users must provide complete GST details at the time of booking.
  • OZRABAS shall not be held responsible for delays in TCS certificate issuance arising from third-party processing timelines.

6. Duplicate Bookings

In the event of a duplicate booking being discovered — whether made by the User through multiple channels or as a result of system error — OZRABAS shall not be responsible for any refund on the duplicate booking. Users are advised to confirm booking status with OZRABAS before making repeat payments.

ACKNOWLEDGMENT & DECLARATION

BY USING THE SERVICES OF OZRABAS GLOBAL WAYFARER SERVICES IN ANY MANNER — INCLUDING MAKING AN ENQUIRY, PAYING A BOOKING DEPOSIT, CONFIRMING A BOOKING, OR TRAVELLING ON AN OZRABAS-ARRANGED ITINERARY — YOU UNCONDITIONALLY ACKNOWLEDGE THAT:

  • You have read, understood, and agree to be legally bound by all four parts of this Legal Policies Compendium.
  • You accept the strict No-Cash-Refund and Cancellation Policy in its entirety without exception.
  • You consent to the exclusive jurisdiction of courts in Jaipur, Rajasthan, India for all disputes.
  • You consent to arbitration proceedings in Jaipur under the Arbitration and Conciliation Act, 1996, if invoked by OZRABAS.
  • You have not relied on any verbal, WhatsApp, or informal representation not contained in the final written Quotation.
  • You are 18 years of age or older and legally competent to enter into this agreement.
  • If booking on behalf of others, you have the authority to bind them to these Terms and have ensured their compliance.
